The Accelerating Reliable Capacity Act of 2024 (ARC Act) is legislation designed to support advanced nuclear energy projects by providing enhanced loan guarantees and financial protections through the Department of Energy. The bill establishes a New Nuclear Investment Accelerator Program Account with $3.6 billion in funding transferred from existing energy appropriations to help cover cost overruns on large nuclear projects that meet specific criteria, including those costing at least $2.5 billion with loan guarantees of $2 billion or more. Under the program, borrowers remain responsible for costs until expenses exceed 120 percent of the project's initial estimate, after which the federal government can contribute up to $1.2 billion per project to cover additional overruns, with payments applied to reduce the loan principal. The legislation also modifies tax treatment to exclude these payments from borrower income and allows nuclear projects to opt out of certain federal investment tax credits. Additionally, the bill requires enhanced project oversight through quarterly meetings between the Department of Energy, lenders, and project stakeholders, with meeting minutes submitted to Congress within a week.
