The DENIED Act would restrict certain entities from using a tariff exemption that allows small packages to enter the United States duty-free. Specifically, it targets entities that have been penalized more than twice in a year for shipping articles produced with forced labor, bearing counterfeit marks, or containing illegal drugs. U.S. Customs and Border Protection would maintain and publish a list of these prohibited entities every 90 days, with entities able to petition for removal after one year if they cease the violations. The bill requires enhanced data collection and documentation from shippers within 180 days and establishes civil penalties of up to $1,000 for first violations and $5,000 for subsequent violations related to this prohibition. It also gives the U.S. Court of International Trade jurisdiction over disputes about removal from the prohibited entity list.
