The Trustworthy By Design Artificial Intelligence Act of 2024 requires the National Institute of Standards and Technology to create comprehensive guidelines for evaluating whether artificial intelligence systems are trustworthy before the federal government uses them. The guidelines must assess AI safety, security, fairness, transparency, privacy, and other key factors across all components of AI systems, with special attention to risks affecting protected groups under federal law. Federal agencies must evaluate any AI systems they currently use within two years to ensure compliance with these guidelines, or stop using them, and all new AI systems must meet the standards before deployment. Each federal agency must also designate a Chief AI Officer within 120 days to oversee compliance, and agencies must publicly report on their AI deployments and any systems that do not yet meet the standards. The NIST Director has one year from enactment to complete the initial guidelines, which must be updated at least annually.
