The Strengthening Our Workforce Act of 2023 would allow certain undocumented immigrants and people with deferred action status to obtain conditional lawful permanent residency for two years with work authorization. To qualify, applicants must have been continuously present in the United States since January 1, 2023, and have worked at least 100 days in designated essential professions such as healthcare, construction, agriculture, food service, childcare, and other critical infrastructure jobs. During the two-year conditional period, beneficiaries must maintain at least 100 days of annual employment in their field and remain physically present in the country, after which they would automatically convert to permanent resident status unless they object. The bill excludes immigrants with felony convictions or multiple misdemeanors, though the Secretary of Homeland Security can waive certain misdemeanor offenses for humanitarian reasons or family unity, and those granted status would not count against existing immigration numerical caps.
