The No AI FRAUD Act would establish federal protections for people's voices and likenesses against unauthorized use in artificial intelligence-generated content. The bill creates a property right in an individual's voice and likeness that is enforceable during their lifetime and for ten years after death, allowing these rights to be transferred or inherited like other intellectual property. Anyone who distributes AI-generated deepfakes or voice cloning services without consent could face penalties of up to fifty thousand dollars per violation for offering cloning services or five thousand dollars per violation for distributing deepfake content, plus actual damages, profits, and potentially punitive damages and attorney fees. The law includes First Amendment protections for news, commentary, and other speech uses, and requires that agreements to use someone's likeness or voice in AI-generated performances must be in writing with legal representation for adults, or court-approved for minors. The bill would take effect 180 days after enactment and applies to both living and deceased individuals.
