The Protecting Access to American Products Act would allow the federal government to temporarily waive requirements that vessels carrying goods between U.S. ports must be built in America, owned by Americans, and crewed by Americans. This waiver would apply when companies demonstrate they cannot find an American-built vessel available to transport specific goods and have made a good faith effort to locate one. The government would have 60 days to approve or deny waiver requests, and if it takes no action within that timeframe, the waiver is automatically approved. Any approved waiver would last at least 30 days and could be extended in 15-day increments if the shortage conditions persist. Congress would need to be notified within 48 hours of any waiver request and approval, including detailed explanations of why the waiver is necessary.
