This bill establishes a new FISA Oversight Office within the Department of Justice to review and challenge applications submitted under the Foreign Intelligence Surveillance Act. The office would evaluate each FISA application and can petition to join court proceedings and file motions if it determines the government hasn't met the legal standard of probable cause, with stricter requirements when Americans are being surveyed. For surveillance of U.S. citizens, the oversight office must challenge any application where probable cause has not been clearly established, while for other cases it has discretion to challenge applications where the standard may not be met. Federal agencies requesting surveillance authority would be required to provide all available evidence to the oversight office and notify it each time an application is filed. Within one year of the law taking effect, the Attorney General and Director of National Intelligence must report to Congress on how many applications the oversight office challenged, information about those cases, and which applications it declined to challenge.
