The DEFIANCE Act of 2024 creates civil legal remedies for people whose intimate images are shared without consent or who are depicted in sexually explicit deepfakes or AI-generated nude images. Under the bill, victims can sue anyone who knowingly produces, possesses, or shares these non-consensual intimate images or digital forgeries in interstate commerce, and can seek damages up to $150,000 plus attorney fees and court costs. The law also allows courts to issue injunctions to stop the distribution of such images and permits victims to protect their privacy during lawsuits by using pseudonyms and filing documents under seal. Victims have up to 10 years from when they discover the violation to file a lawsuit, and the bill does not prevent states and tribes from passing their own stronger protections on the same issue.
