Referred to the Committee on Foreign Affairs, and in addition to the Committee on the Judiciary, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
The Combatting China's Pilfering of Intellectual Property Act would authorize the President to impose sanctions against individuals and entities from China that steal American intellectual property or receive stolen intellectual property through a pattern of significant theft. Sanctions would include blocking their assets in the United States and making them ineligible for visas or entry into the country. The bill also restricts visas for senior Chinese Communist Party officials, government cabinet members, active-duty military members, and their families, unless the Director of National Intelligence certifies that China has ceased intellectual property theft efforts. The President must submit a report within 180 days identifying specific persons meeting the sanctions criteria, and the Secretary of State must provide a separate report on visa screening effectiveness and Chinese military and intelligence research institutions. The President can waive sanctions on a case-by-case basis if it serves national security interests or terminate sanctions if a person stops engaging in intellectual property theft.
