The Protecting Whistleblowers from Retribution Act would strengthen protections for FBI employees who report wrongdoing by giving the Justice Department's Inspector General authority to investigate retaliation against these whistleblowers. Currently, the FBI has primary responsibility for handling such complaints, which critics argue creates a conflict of interest. Under this bill, the Inspector General would receive allegations, investigate within 240 days, and can request the Merit Systems Protection Board to temporarily halt personnel actions while investigations proceed. If retaliation is found, the bill allows for corrective actions including reinstatement, back pay, attorney's fees, and damages up to $10,000 in civil penalties against those who commit retaliation. The Inspector General would also be required to submit annual reports to Congress detailing investigations conducted, findings of retaliation, and actions taken. The bill becomes effective 90 days after enactment, with the Attorney General required to issue implementing regulations within the same timeframe.
