The Sue VOYEURS Act creates a federal civil lawsuit right for people who have intimate images or videos of themselves captured without consent. The law allows victims to sue the person responsible in federal court and recover either their actual damages or $150,000 per image, plus attorney's fees and court costs. The legislation also empowers courts to issue orders stopping further distribution of the images and allows legal guardians or family members to sue on behalf of minors, deceased individuals, or those unable to act on their own behalf. The bill applies when the unauthorized recording involves interstate commerce or interstate communication in any form, such as using the internet, mail, or any electronic means. Law enforcement officers conducting surveillance under a valid warrant are exempt from civil liability under this law.
