The Stealthing Act of 2024 would create a federal civil remedy allowing victims to sue individuals who remove condoms or other sexual protection barriers without consent during sexual activity. Research cited in the bill indicates that approximately 10 percent of men have engaged in non-consensual condom removal and 12 percent of women have experienced this form of sexual violence, which exposes victims to risks including pregnancy and sexually transmitted infections. The legislation establishes federal jurisdiction over these cases when they involve interstate commerce, interstate travel, or other connections to federal commerce channels, allowing victims to recover compensatory and punitive damages as well as injunctive relief. California became the first state to criminalize stealthing in 2021, and this bill would extend similar protections at the federal level. The measure was introduced in April 2024 with bipartisan support and referred to the House Judiciary Committee.
