To amend title 18, United States Code, to prohibit former employees of covered health agencies from serving on the board of entities involved in development and research of a drug, biological product, or device and from profiting from a drug, biological product, or device, and for other purposes.
The FAUCI Act would impose new restrictions on senior federal health officials at the National Institutes of Health, Food and Drug Administration, and Centers for Disease Control and Prevention. The legislation would prohibit these officials from serving on boards of companies that develop or research drugs, biological products, or medical devices for eight years after leaving government service. It would also ban former federal health employees who approved grants from profiting from drugs or devices they helped fund, with violations subject to civil penalties of $250,000 and prison sentences of one to five years. Additionally, the bill would prevent senior health officials from patenting drugs, biological products, or devices during their federal employment and require current officials and their spouses to disclose any existing patent interests within 180 days of the law's enactment. The restrictions would apply to employees at the GS-13 pay grade and above, as well as anyone with authority to approve drug or device authorizations, taking effect upon enactment for future employees and within six months for current employees.
