To provide for the implementation of a system of licensing for purchasers of certain firearms and for a record of sale system for those firearms, and for other purposes.
# Blair Holt Firearm Owner Licensing and Record of Sale Act of 2024
This bill would establish a federal licensing system for people who own handguns and semi-automatic rifles with detachable magazines holding more than 10 rounds. Anyone purchasing or possessing such firearms would need to obtain a federal firearm owner license or qualify under a state-certified licensing system. The licensing process requires applicants to be at least 21 years old, pass a criminal background check using fingerprints, demonstrate they have no disqualifying mental health history, and pay a fee capped at $10. Licenses would expire every five years and require renewal.
The bill also creates a federal record-keeping system for all qualifying firearm sales and transfers, with dealers required to verify buyer licenses and report transactions to the Attorney General within 14 days. All firearm transfers between private individuals would need to go through a licensed dealer, with limited exceptions for family members, temporary hunting or shooting range use, and emergency situations. Owners of qualifying firearms must report thefts or losses to the Attorney General within 72 hours and notify the Attorney General of address changes within 60 days.
The legislation imposes criminal penalties of up to 10 years in prison for violating the licensing requirements and creates enhanced penalties for child access to firearms. It establishes procedures for denying or revoking licenses and allows individuals to appeal denials in federal court. States with comparable firearm licensing and record systems can seek federal certification to administer these requirements themselves.
