The Clear the ROADS Act of 2024 directs the Secretary of Transportation to withhold 10 percent of highway funding apportionments from states that do not make reasonable efforts to prohibit people from recklessly obstructing roadways on federal-aid highways in ways that endanger public safety. The bill applies to individuals who are not performing government work and knowingly block vehicle traffic. States would have until the first October 1 after either the Transportation Secretary issues implementing regulations or the state holds a legislative session, whichever comes later, to comply with the requirement. The Transportation Secretary must issue regulations to carry out the provision within 180 days of the law's enactment and would certify annually whether each state meets the obstruction-prevention requirement. Noncompliant states would lose federal highway funding starting on October 1 each year that they do not meet the standard.
