Currently, the Food and Drug Administration can only destroy certain refused imports under limited circumstances, but this legislation broadens that power to include any article the Secretary of Health and Human Services determines presents a significant public health concern. The bill also makes it illegal for anyone to move or introduce into commerce products that the government has decided to destroy under this expanded authority. The FDA must finalize new regulations within 90 days of the law's enactment to implement these changes, and the new destruction authority becomes effective 180 days after the bill is signed into law. The legislation applies to all imports, including exported goods, and requires any new regulations to comply with applicable international trade agreements.
