The Sunset Chevron Act would eliminate federal regulations that were previously upheld in court under Chevron deference, a legal doctrine requiring judges to defer to federal agency interpretations of ambiguous laws. Within 180 days of the bill's enactment, the Government Accountability Office would compile a list of all such rules still in effect and assign sunset dates to them, with the most recent rule expiring 30 days after publication and each older rule expiring 30 days after the one issued after it. This staggered timeline would systematically eliminate decades of regulations across all federal agencies unless Congress takes action to preserve them. The bill also changes Congressional Review Act procedures to allow Congress to more easily block these rules through expedited procedures. The legislation would affect thousands of environmental, workplace safety, healthcare, and financial regulations that have been defended in federal courts.
