The Cooper Davis and Devin Norring Act would require internet companies and online service providers to report suspected illegal drug activity to the Drug Enforcement Administration within 60 days of discovering it. Specifically, providers must report when they find evidence of fentanyl or methamphetamine manufacturing and distribution, counterfeit prescription drugs, or illegal prescription drug sales. Companies would submit information about user accounts, IP addresses, and related communications, though the bill protects end-to-end encryption and does not require companies to actively monitor users or decrypt messages. Violations would result in criminal fines of up to $190,000 for first offenses and $380,000 for subsequent violations, plus civil penalties of $50,000 to $100,000 for knowingly submitting false reports. The DEA must publish annual reports on the number and outcomes of reports received, and the law includes safeguards limiting how long reports are stored and restricting law enforcement from using this reporting system to investigate users.
