The Let America Vote Act would require all states to allow unaffiliated voters to participate in primary elections for federal office, with the restriction that these voters cannot vote in more than one party's primary. The bill also includes provisions protecting unaffiliated voters' privacy by prohibiting states from sharing their personal information with political parties for fundraising or other political purposes, and bars states from automatically registering voters as party members based solely on their primary participation. To encourage compliance, states that certify compliance with these requirements would receive federal grants equal to 2 percent of their Help America Vote Act funding for five consecutive fiscal years, with the money designated for implementing open primary systems. Additionally, the legislation includes a separate provision affirming that noncitizens cannot vote in any taxpayer-funded election and requires states to certify noncitizen voting restrictions to receive federal election administration funds. The requirements for federal office primaries would take effect immediately upon enactment, while states could voluntarily extend the same rules to state and local primaries to maintain their federal funding eligibility.
