To amend title 5, United States Code, to require the publication of scientific data, incident data, or other pertinent data relied on by an agency to justify a rule.
The Show Me the Science Act requires federal agencies to publicly disclose all scientific data, incident data, and other relevant information they use to justify new regulations. When agencies publish new rules, they must include the underlying data that supports those rules in the Federal Register, making this information available to the public for review and scrutiny. The only exception allows agency heads to withhold data if they determine that publication would threaten public safety or security, though they must still notify the Office of Information and Regulatory Affairs and publish their reasoning. The bill directs the Office of Information and Regulatory Affairs to issue guidance to agencies on how to comply with this requirement and to monitor their compliance. This legislation applies to all federal agencies that issue regulations and would affect any business, organization, or individual subject to federal rules by giving them access to the scientific basis for those regulations.
