To provide for the reallocation of certain grant funds from jurisdictions that do not allow for consideration the danger, risk, or threat an individual poses to the community when determining bail or pretrial release or that have in effect a policy providing for the sealing of certain criminal records.
The Keep Our Streets Safe Act of 2024 is a federal funding bill that would penalize states that restrict judges' ability to consider a defendant's danger to the community when setting bail or pretrial release conditions. The legislation also targets states with policies that automatically seal felony criminal records. Under this bill, states that fail to meet these requirements would lose federal grant funding from the Byrne Grants program, a major source of law enforcement financing. Any withheld funds would be redirected to local governments within those states to use for law enforcement purposes. The bill was introduced in September 2024 and referred to the House Judiciary Committee.
