The Toxic Free Food Act of 2024 directs the FDA to update its rules governing food additives classified as "generally recognized as safe" (GRAS), a designation that currently allows manufacturers to use certain substances in food without prior FDA approval. The bill requires manufacturers to notify the FDA and provide detailed safety information before marketing any substance as GRAS, including data on cumulative effects, safety factors, and impacts on vulnerable populations and developing children. The FDA would then have at least 90 days to review each determination and allow public comment before the substance can be used. The legislation also prohibits newly synthesized chemicals, carcinogenic substances, and determinations made by experts with conflicts of interest from receiving GRAS status, and requires the FDA to reassess all previously approved GRAS substances that don't meet the new standards. The FDA must complete the proposed rule update within 180 days of enactment and finalize it within 90 days after the public comment period closes.
