This bill directs the U.S. Trade Representative to monitor South Korean digital trade policies and respond to regulations that discriminate against American technology companies. Within 30 days of South Korea enacting or implementing any law that targets U.S. digital platforms with business restrictions, the Trade Representative must report to Congress on whether South Korea has violated trade agreements or imposed unfair restrictions on American commerce. If the report confirms such violations or unfair practices, the Trade Representative is authorized to take enforcement action, including filing disputes with the World Trade Organization, initiating investigations under existing trade law, or pursuing remedies through the U.S.-Korea Free Trade Agreement. The bill reflects concerns that South Korea's $51.1 billion trade surplus with the United States results partly from discriminatory policies that favor Chinese technology companies while making it difficult for American firms to invest and operate there. The legislation aims to ensure reciprocal trade treatment between the two countries while maintaining their broader strategic and security partnership.
