This bill makes it illegal for the President or Vice President, or entities they control, to buy, sell, or exchange nonpublic government information for financial gain. It also prohibits anyone else from purchasing, selling, or trading such information. Violations can result in criminal penalties including fines up to twice the transaction value and up to five years in prison, along with forfeiture of any profits gained. The legislation also allows the Attorney General to pursue civil cases seeking disgorgement of profits, civil penalties up to three times the gain, and injunctions, with a six-year window to file such actions. The Office of Government Ethics is tasked with referring credible evidence of violations to the Attorney General and notifying Congress's judiciary committees of these referrals.
