The Stop ICE Price Gouging Act would cap the price markup on items sold at immigration detention facility commissaries. Essential items like hygiene products, toiletries, and writing supplies would be limited to a 5 percent markup above vendor cost, while nonessential items would be capped at a 35 percent markup. The bill also prohibits additional fees and revenue sharing arrangements between detention facilities and commissary operators. If detainees are overcharged, they must receive refunds, and any unclaimed overcharges would go into a Detainee Welfare Fund for educational and recreational items benefiting detained individuals. The Director of U.S. Immigration and Customs Enforcement would enforce the rules and submit compliance reports to Congress every 90 days, while the Department of Homeland Security Inspector General would conduct audits and investigate violations.
