The AI Advertising Disclosure Act requires companies operating AI chatbots and AI-powered search tools with more than 50,000 monthly users to clearly disclose when their responses are influenced by paid commercial arrangements, sponsored content, or affiliate relationships. Companies must maintain real-time registries of these commercial deals and allow users to ask whether any response came from a commercial arrangement, while prohibiting deceptive practices like instructing AI systems to deny being commercial tools or using design tricks to hide disclosures. The Federal Trade Commission must issue detailed regulations within 180 days and every three years thereafter, with enforcement authority to treat violations as unfair or deceptive practices. The bill also creates a private right of action allowing consumers to sue for actual damages or up to $1,000 per violation, with potential treble damages for willful violations, along with attorney's fees for winning plaintiffs. The requirements take effect 12 months after the bill becomes law.
