This bill modifies Social Security benefits for widows and widowers in households where both spouses had earned income. Currently, surviving spouses can receive either their own Social Security benefit or a percentage of their deceased spouse's benefit, whichever is lower. This legislation would allow widows and widowers to receive the greater of two amounts: their deceased spouse's full primary insurance amount or 75 percent of the combined total of their own earned benefit plus their deceased spouse's benefit. The change applies to widows, widowers, and surviving divorced spouses who are fully insured. The bill includes a protection for Supplemental Security Income recipients to ensure they don't lose benefits as a result of the change. These amendments take effect for benefits paid for months after December 2026.
