The DHS Community Consultation Act of 2026 requires the Department of Homeland Security to consult with local communities before building or leasing facilities to detain immigrants. Before construction, DHS must hold public meetings, gather input from local officials, community leaders, and emergency responders for at least 60 days, and assess impacts on healthcare, emergency services, water systems, power grids, and roads. The bill also prohibits DHS from converting non-residential buildings like warehouses or storage facilities into detention centers, bars detention facilities from being built on military bases, and requires local health coordination to manage disease outbreaks in detention facilities. Additionally, if a local government passes an ordinance prohibiting such facilities, DHS cannot build in that area. The legislation applies to all immigration detention under federal law and gives communities a formal role in deciding whether detention facilities locate in their areas.
