The Congressional Pension Accountability Act would strip members of Congress of their pensions if they are expelled or resign following a serious misconduct investigation. Specifically, if a member is expelled or if an ethics committee investigative subcommittee determines there is substantial reason to believe the member violated the Code of Official Conduct or other standards, all their congressional service would become ineligible for calculating retirement benefits under either the Civil Service Retirement System or the Federal Employees Retirement System. Members would receive refunds of their own contributions to these systems, but would forfeit any government contributions and earnings, and individuals who already received pension payments before the expulsion or ethics finding would not be required to repay those amounts. The bill applies to any expulsions or ethics findings based on conduct occurring after the law's enactment, and notably specifies that presidential pardons or sentence commutations would not restore forfeited pensions.
