This bill requires publicly funded sports stadiums with at least 10,000 seats to cap concession prices at no more than 7 percent above market rate and prohibits them from charging small businesses fees to operate concession stands. The legislation applies to venues that receive any form of public funding, including federal grants, subsidies, tax exemptions, or tax-exempt bonds, but excludes college and university stadiums. Stadiums must also encourage concession service providers to offer lease opportunities to small businesses when negotiating commercial contracts. The Federal Trade Commission will enforce these rules and treat violations as unfair or deceptive business practices under existing FTC authority, with violators subject to standard FTC penalties.
