The No ICE Deaths in the Dark Act of 2026 requires U.S. Immigration and Customs Enforcement to establish comprehensive notification, reporting, and review procedures whenever someone dies in ICE custody or within 30 days of release. ICE must notify the deceased's next of kin, the relevant foreign consulate, the Department of Homeland Security Inspector General, and Congress within 24 hours of each death, and must publish an interim public notice on its website within 48 hours with basic facts about the death. Within 30 days, ICE must post a detailed detainee death report including the person's name, cause of death, medical history, and circumstances, and within 60 days must complete a medical mortality review examining whether policy changes are needed; a more comprehensive detention death review must follow within 180 days. The agency must preserve all records and evidence related to each death and submit quarterly reports to Congress on all covered deaths and the status of ongoing reviews. The law applies to deaths occurring 90 days after enactment and includes privacy protections while ensuring Congress maintains access to all information except where federal law prohibits disclosure.
