Summary

The Environmental Health Restoration Act of 2026 would require the Environmental Protection Agency to reinstate environmental protections that the bill claims were weakened or eliminated since January 2025. Specifically, within 60 days of enactment, the EPA would need to restore regulations covering greenhouse gas emissions from power plants, methane pollution from oil and gas operations, mercury and air toxics standards, vehicle emissions standards, and air quality standards for fine particulate matter. The bill also prohibits future deregulation of these standards unless Congress explicitly authorizes it and directs the EPA to restore its scientific advisory boards, use the social cost of carbon in rulemaking decisions, and restore environmental justice programs. The legislation authorizes approximately $11 billion in additional EPA funding for fiscal year 2027 and subsequent years to support enforcement efforts and requires annual reports to Congress on enforcement activities. The bill would allow individuals to sue in federal court to enforce its requirements and grants courts the authority to award attorney's fees if the EPA fails to comply.
