This bill eliminates tax breaks that allow data center companies to reduce their federal income taxes through accelerated depreciation deductions. Specifically, it removes data centers from "bonus depreciation" rules that let businesses deduct the cost of equipment and property more quickly than normal, and it prevents data centers from qualifying for tax benefits in opportunity zones, which are economically distressed areas designated for preferential tax treatment. The bill targets large data centers with power capacity exceeding 50 megawatts that are used for data storage, processing, artificial intelligence, and related services. The changes take effect for data center property placed in service after the bill is enacted. The legislation was introduced by Representative McDonald Rivet and a bipartisan group of colleagues in September 2026 and referred to the House Ways and Means Committee.
