The Environmental Health Restoration Act of 2026 would reverse environmental deregulation actions taken by the EPA since January 2025 and restore enforcement of clean air and climate protections. Within 60 days of enactment, the bill requires the EPA to reinstate regulations that were in effect on January 19, 2025, covering greenhouse gas emissions from power plants and vehicles, methane pollution from oil and gas operations, mercury and air toxics standards, and other air quality protections. The legislation prohibits the EPA from weakening these rules unless Congress explicitly authorizes such changes, and it mandates the restoration of scientific advisory boards and the use of peer-reviewed science in regulatory decisions. The bill authorizes approximately $11 billion annually for EPA enforcement and compliance activities and requires the agency to restore and expand environmental justice programs, with particular attention to communities experiencing disproportionate pollution. Additionally, the bill allows individuals and states to sue in federal court to enforce these requirements and allows states to maintain their own stricter environmental standards.
