The Enduring Accountability Act would amend military law to allow the Secretary of each military department to separate service members from the Armed Forces if they accept a presidential pardon or commutation of sentence. When a service member accepts such a pardon or commutation, the Secretary would be required to convene a board within 30 days to review the conduct underlying the pardon or commutation and recommend whether the member should be separated, regardless of the pardon itself. The military department would notify the Secretary of Defense within 30 days of the pardon acceptance, the board's convening, and the board's recommendation. Within 30 days of the board's recommendation, the Secretary of Defense would be required to report to Congress detailing the board's findings and whether the Secretary authorized the separation, or if not authorized, the justification for that decision. The bill contains no specific funding authorizations or implementation timelines beyond the 30-day notification and reporting requirements.
