The No Secrets for Data Centers Act of 2026 would prohibit companies from using nondisclosure agreements to keep quiet about large data center construction projects, particularly those receiving public funding or incentives. The bill voids and makes unenforceable any predispute nondisclosure clauses in contracts involving data centers with a power capacity exceeding 50 megawatts when public officials are party to the agreement or when public funds, land, or incentives are involved. Data center operators would also be barred from receiving any public incentives that are conditioned on restricting the disclosure of information about data center development. The legislation applies to claims filed under federal, state, or tribal law after its enactment and allows states to maintain their own nondisclosure protections if they are equally protective of free speech rights. The bill does not specify funding amounts or implementation timelines.
