This bill amends the Medicaid program to require states to establish legal protections for Medicaid whistleblowers starting January 1, 2028. The legislation protects employees, contractors, and agents of state Medicaid agencies who report violations of law, fraud, waste, abuse, mismanagement, or threats to public health and safety. States must provide a process for whistleblowers to seek relief through administrative proceedings and, if needed, court proceedings, with potential remedies including job reinstatement, double back pay with interest, compensation for damages including attorney fees, and punitive damages in cases of malice or reckless indifference. The bill applies broadly to anyone involved in administering or delivering Medicaid services and allows reporting to state Medicaid agencies, law enforcement, the Department of Health and Human Services, Congress, or other entities designated by the Secretary.
