The America Votes Act of 2026 would allow voters in states with identification requirements to cast a ballot by submitting a sworn written statement under penalty of perjury instead of presenting a physical ID document. The bill applies to federal elections and would permit both in-person voters to present the sworn statement to election officials and mail-in voters to submit it with their ballot. States would be required to prepare pre-printed versions of the statement, make copies available at polling places, and include copies with mail-in ballots, while also informing voters at polling places about this option through posted information materials. The legislation would not allow states to require these voters to cast provisional ballots instead of regular ballots. The amendments would take effect immediately upon enactment of the bill.
