The Ad-Free Means Ad-Free Act would prohibit video streaming services from advertising ad-free subscriptions and then adding advertisements to those services within one year of a customer's enrollment or the length of their contract, whichever is longer. The bill also prevents companies from circumventing this rule by allowing customers to cancel and re-enroll in the same service. The Federal Trade Commission would have one year after the bill's enactment to write regulations implementing these requirements and would enforce violations as deceptive practices under existing FTC authority. The legislation applies to all streaming services offered directly to consumers through internet-based distribution, regardless of whether they are sold through third-party platforms. This bill targets a recent industry practice sometimes called "enshittification," where streaming companies lure customers with ad-free options and later switch them to ad-supported tiers.
