The Public Service Freedom to Negotiate Act of 2025 establishes federal minimum standards for public employee collective bargaining rights and creates federal oversight to ensure states comply. The Federal Labor Relations Authority (FLRA) will have 180 days to assess whether each state's laws provide equivalent protections for union organizing, collective bargaining, dues deduction, and binding dispute resolution, with enforcement beginning 2 years after the bill's enactment for states found noncompliant. The FLRA must issue implementing rules within one year and will gain broad enforcement powers, including authority to supervise union elections, determine bargaining units, and resolve violations in noncompliant states. The bill also allows individuals to sue state officials in federal court for violations after 180 days if the FLRA has not yet filed enforcement action, with courts able to award attorneys' fees. Essentially, this legislation would require states to meet federal collective bargaining standards or face federal agency administration of public employee labor relations.
