The SAFE Supply Chains Act requires the Department of Defense to purchase information and communications technology products only from original equipment manufacturers or their authorized resellers, rather than from third-party vendors or the secondary market. The bill aims to strengthen supply chain security and reduce risks from counterfeit or compromised equipment. The Secretary of Defense can waive this requirement only in limited circumstances—for scientifically valid research or to prevent harm to mission-critical functions—and must notify Congress when doing so with details about security measures and justification. The bill requires annual reports to Congress for six years tracking the number of waivers granted and efforts to reduce them, and requires the Department to provide guidance to help other vendors become authorized resellers. The law takes effect one year after enactment and requires no additional federal funding.
