The Public Safety Free Speech Act protects law enforcement officers, firefighters, and emergency medical services personnel from being fired or punished by their employers for expressing personal opinions on matters including public safety delivery, compensation, working conditions, employer policies, and political or religious beliefs. The bill allows covered employees to sue their employers for damages, attorney fees, and other relief if they face adverse employment actions based on their speech. However, the protection does not extend to statements made while on duty, comments encouraging violence or illegal activity, speech that discriminates against others or withholds essential services as protest, or statements that expose confidential personal information about individuals the employee encountered at work. The legislation applies to law enforcement agencies, fire departments, and emergency medical services employers at the federal, state, and local levels, and does not override existing civil rights laws.
