This bill requires the Department of Defense to promote competition when purchasing artificial intelligence, cloud computing, and data infrastructure services from major tech companies. Specifically, the DOD must use competitive bidding processes, prioritize multi-cloud technology to avoid dependence on a single vendor, and protect government data from being used by contractors to improve their commercial products without authorization. The legislation affects major cloud and AI providers that have earned at least $50 million in DOD contracts over the previous five years, as well as small businesses and newer companies seeking DOD work. The Secretary of Defense and the Chief Digital and Artificial Intelligence Officer must update procurement rules to enforce these protections, with violations subject to fines and contract termination. Starting January 15, 2027, and annually for four years thereafter, DOD officials must report to Congress on competition and market concentration in the defense AI space, with a publicly available summary posted on the Department of Defense website.
