The EDUCATE Act would prohibit graduate medical schools from receiving any federal financial assistance—including student loans and research funding—unless they certify that they do not maintain diversity, equity, and inclusion (DEI) offices or require students and staff to affirm certain statements about race, gender, or systemic inequality. Specifically, schools would have to certify they do not compel anyone to state that certain races or genders constitute oppressor or oppressed groups, that systemic racism exists in America, or that individuals bear collective responsibility for historical wrongs. The bill also bans schools from requiring diversity statements as part of hiring or admissions, from offering race-based educational tracks, or from making race-based distinctions among students. Medical school accrediting agencies would be prohibited from requiring schools to adopt DEI policies as a condition of accreditation. The legislation includes carve-outs allowing medical schools to teach about health conditions specific to certain populations, collect demographic data, and operate in compliance with existing civil rights laws, while also protecting religious institutions' ability to maintain their missions.
