The OCTOPUS Act of 2025 prohibits the farming of octopuses for food production in the United States and its waters, and bans the importation and re-export of commercially farmed octopus. The Secretaries of Commerce and Interior must issue final rules within one year of enactment to enforce these prohibitions, and importers must certify that any octopus they bring into the country is not commercially farmed, with violations subject to civil penalties up to $100,000 or the fair market value of the octopus—whichever is greater. The ban on imported farmed octopus takes effect one year after the law passes. The legislation includes narrow exceptions for octopus used only by accredited aquariums and zoos for public display, breeding, or research, and requires the National Oceanic and Atmospheric Administration to track harvest methods for wild-caught octopus imports.
