S. 2026
The Court Legal Access and Student Support Act of 2025 (CLASS Act) would prohibit colleges and universities from forcing students to sign arbitration agreements as a condition of enrollment. Currently, many schools require students to agree that disputes must be settled through private arbitration rather than in court, which can limit students' legal rights and access to jury trials. This bill would ban that practice, ensuring students can pursue claims against their institutions in regular courts instead. The legislation applies to all higher education institutions that participate in federal student aid programs and takes effect one year after it becomes law. The bill has no specified funding requirements, as it primarily restricts what institutions can require rather than creating new government programs.
