The RISE Act would provide legal immunity from civil liability to artificial intelligence developers when their AI systems make errors while being used by licensed professionals—such as doctors, lawyers, and financial advisors—in serving clients. To qualify for this immunity, developers must publicly release and maintain detailed technical documentation about their AI systems, including performance metrics, known limitations, and appropriate uses, though they can redact trade secrets if properly justified. The immunity covers errors that result from normal use but does not protect developers from liability for reckless or willful misconduct, fraud, or misrepresentation. Developers must also update their documentation within 30 days of releasing new versions or discovering significant problems with their AI systems, or they lose immunity protection. The law takes effect on December 1, 2025, and applies to any incidents occurring after that date.
