The Refund Equality Act of 2025 allows legally married same-sex couples to amend their federal tax returns and claim refunds outside the normal time limits. The bill specifically targets couples whose marriages were not federally recognized before September 16, 2013, when the government first recognized same-sex marriages for tax purposes. If these couples filed individual tax returns instead of joint returns for years before that date because same-sex marriage wasn't yet recognized, they can now file amended joint returns and request refunds they may have been owed. The deadline for making these amendments and filing refund claims is the tax filing deadline for the year in which this law is enacted.
