This bill immediately prohibits U.S. individuals and companies from investing in Venezuela's energy sector until the country's government recognizes the July 28, 2024 presidential election results, which congressional findings state showed opposition candidate Edmundo González winning by a decisive margin over current leader Nicolás Maduro. The ban applies to all petroleum-related transactions previously allowed under agreements between Maduro's government and the opposition, as well as transactions under two existing Treasury Department licenses. The Secretary of the Treasury will enforce the prohibition and can impose penalties on violators under existing international economic emergency laws, while the President retains the ability to waive the restrictions on national security grounds with congressional notification. The investment ban will automatically end once the President certifies that Maduro's regime has acknowledged González's electoral victory and either relinquished power or transferred it to a transitional government acceptable to the opposition.
