The Protecting Older Americans Act of 2025 prohibits companies and employers from enforcing forced arbitration agreements in age discrimination cases. Under this bill, workers aged 40 and older who believe they have faced age discrimination—whether through unfair treatment, unequal pay, harassment, or retaliation—can choose to pursue their claims in court instead of being forced into private arbitration. The legislation also prevents employers from using "class action waivers" that would bar employees from joining together in collective legal actions over age discrimination. Courts, not arbitrators, will decide whether this law applies to any given dispute. The bill takes effect immediately upon enactment and applies to all age discrimination claims that arise after that date.
